1. Services Offered
Positive Behaviour Change Solutions provides psychological services, including but not limited to therapeutic services, group programs, consultation, review, supervision and training.
2. Duty of Care
We ensure that we provide a standard of care that is reasonable and competent in our engagement with clients. This includes ensuring that services are delivered in a manner that protects the well-being and safety of clients. We make informed decisions, consider the best interests of our clients, and take appropriate actions to avoid causing harm. We maintain professional boundaries, uphold confidentiality, and engage in ongoing professional development to ensure our practices meet current standards.
Services are delivered by registered psychologists who are accredited in accordance with the Australian Health Practitioner Regulation Agency (AHPRA). Associates will be required to have the relevant registrations according to their specific profession. All staff will be required to have current Working with Vulnerable People Checks and Criminal History Checks.
3. Ethics
We adhere to the code of ethics set forth by the Australian Psychological Society and the standards set by AHPRA and the Psychology Board of Australia and all other applicable regulatory bodies.
4. Informed Consent
Before commencing service, we will provide clients with comprehensive information about the nature of the proposed services including the purpose, potential risks and benefits, and alternatives. Clients will be required to provide their written consent prior to the delivery of services.
5. No Guarantee of Results
While we strive to provide services of highest quality of services, we cannot guarantee specific outcomes. Individual results can vary, and the effectiveness of services may depend on various factors that are specific to each client.
6. Confidentiality
We recognise the importance of privacy and confidentiality concerning our clients. All client interactions and information are kept strictly confidential, except as required or permitted by law.
7. Mandatory Reporting
Mandatory reporting aims to protect vulnerable children and ensures that they receive the support and interventions necessary for their safety and well-being. We are required to report when we have a reasonable belief that is experiencing, or is at risk of, significant harm due to abuse or neglect. We maintain familiarity with the relevant legislation and comply with these legal requirements while balancing the ethical duty to maintain client confidentiality.
8. Subpoenas and confidentiality
A subpoena requires the provision of specific information or documents as part of a legal proceeding. While we are ethically bound to protect client privacy, we must also comply with legal demands. We will work with clients and legal counsel to minimise disclosure while adhering to the law and will always maintain transparency during this process.
9. Client Responsibilities
Clients are encouraged to participate actively in the services delivered and to communicate with us. It is the responsibility of clients to attend scheduled appointments and to provide complete and accurate information about their health history and their goals.
10. Fees
Fees for services will reflect Australian standards and vary according to the type of service delivered. We are open to negotiate fees and payment options.
11. Cancellation and Rescheduling Policy
To cancel or reschedule an appointment, clients are requested to give at least 24 hours' notice. Failure to notify us within this timeframe may result in a cancellation fee, which will be detailed in our client agreement.
12. Circumstances for Termination of Service
Clients have the right to withdraw from services at any time. Services may be terminated by either the client or the service for a variety of reasons including:
o Goal Achievement
o Client Preference
o Financial Constraints
o Conflict of Interest
o Therapist Move or Availability
o Crisis Resolution
o Therapeutic Relationship Issues
o Change in Circumstances
13. Limitation of Liability
Positive Behaviour Change Solutions and its professionals shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the maximum extent permitted by applicable law.
14. Changes to this Legal Notice
We reserve the right to amend this Legal Notice from time to time. Clients are encouraged to review this notice regularly to stay informed about any changes to our policies.
15. Governing Law
This Legal Notice is governed by the laws of the State of Tasmania and the Commonwealth of Australia.
